Terms of Use

Effective Date: May 5, 2026

These Terms of Use ("Terms") form a binding agreement between you and WaveTracer ("WaveTracer," "we," "us," or "our") and govern your use of the WaveTracer mobile application and any related services (collectively, the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Safety notice. WaveTracer provides informational weather, tide, and marine data sourced from the U.S. National Oceanic and Atmospheric Administration (NOAA) and similar public sources. It is not a navigation, safety, or emergency-response tool. Conditions on the water can change without warning. Always carry independent safety equipment, monitor official marine weather broadcasts, and use your own judgment. Do not rely on the App as your only source of weather, tide, or navigation information.

1. Eligibility

You must be at least 13 years old (or the minimum age required to consent to use online services in your country) to use the App. If you are between 13 and the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.

2. Your Account

Some features require an account. You agree to provide accurate information, keep your credentials confidential, and notify us promptly if you believe your account has been compromised. You are responsible for activity that occurs under your account.

You may delete your account at any time from Settings → Account → Delete Account in the App. Deletion is permanent.

3. WaveTracer Pro Subscription

Certain features of the App require a paid subscription ("WaveTracer Pro"). Subscriptions are sold and billed by Apple through your Apple ID and the App Store, in accordance with Apple's standard terms.

Subscription terms

Auto-renewal. WaveTracer Pro subscriptions automatically renew at the end of each billing period (monthly or annually, depending on the plan you choose) unless auto-renewal is turned off at least 24 hours before the end of the current period.
Billing. Your Apple ID will be charged at confirmation of purchase, and again at each renewal at the then-current price for the chosen plan. Prices are shown in the App at the time of purchase.
Free trials. If a free trial is offered, any unused portion of the trial is forfeited if you purchase a subscription before the trial ends.
Managing your subscription. You can view, change, or cancel your subscription in iOS Settings → [Your Name] → Subscriptions, or by tapping Manage Subscription from WaveTracer Settings. Cancellation takes effect at the end of the current billing period.
Refunds. All purchases are processed by Apple. Refund requests are governed by Apple's policies. You can request a refund at reportaproblem.apple.com.

4. License to Use the App

Subject to these Terms, WaveTracer grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use. You may not:

Copy, modify, or create derivative works of the App;
Reverse engineer, decompile, or disassemble the App, except to the extent expressly permitted by applicable law;
Remove or alter any proprietary notices or labels;
Use the App to violate any law or the rights of any third party;
Use the App in commercial fishing, charter, or rescue operations as a primary information source.

WaveTracer and its licensors retain all right, title, and interest in and to the App, including all intellectual property rights. These Terms do not grant you any rights other than those expressly stated.

5. Third-Party Services and Data

The App displays data from third-party sources, including NOAA. That data is provided as-is, and WaveTracer is not responsible for its accuracy, completeness, or availability. The App also relies on services from Apple, Supabase, and RevenueCat. Your use of those services may be governed by their respective terms.

6. User Content

You retain ownership of content you create in the App (such as trip notes and saved locations). By using the App, you grant WaveTracer a limited license to host, store, and process that content solely to provide the App's features to you and to back up your data. We do not claim ownership of your content and we do not use it for marketing or advertising.

7. Acceptable Use

You agree not to use the App to:

Violate any applicable law or regulation;
Interfere with or disrupt the App, our servers, or our service providers;
Attempt to gain unauthorized access to any account or data;
Submit malicious code or attempt to overload our infrastructure;
Misrepresent your identity or affiliation.

8. Disclaimers

The App and all data, content, and services provided through it are offered on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted operation. WaveTracer does not warrant that the App will meet your requirements, that defects will be corrected, or that the App will be free of viruses or other harmful components.

Weather, tide, marine forecast, and location data displayed in the App are informational only. WaveTracer is not a substitute for proper navigation tools, marine safety equipment, official marine forecasts (e.g., NOAA Weather Radio, U.S. Coast Guard advisories), or sound judgment. You assume all risk associated with on-water activities.

9. Limitation of Liability

To the maximum extent permitted by law, WaveTracer and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the App, even if WaveTracer has been advised of the possibility of such damages.

In no event will WaveTracer's total aggregate liability arising out of or relating to these Terms or the App exceed the greater of (a) the amount you paid WaveTracer in the twelve months preceding the event giving rise to liability, or (b) twenty U.S. dollars ($20.00 USD).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless WaveTracer and its officers, directors, employees, and affiliates from any claim, demand, or expense (including reasonable attorneys' fees) arising out of (a) your misuse of the App, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or if continued provision of the App is impractical or unlawful. You may stop using the App at any time. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and dispute resolution) will survive.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App will be brought exclusively in the state or federal courts located in Florida, and you and WaveTracer consent to the personal jurisdiction of those courts.

13. Apple-Specific Terms

The following terms apply if you obtain the App through the Apple App Store. You acknowledge that these Terms are between you and WaveTracer, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.

Scope of license. The license granted to you is limited to using the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions.
Maintenance and support. WaveTracer is solely responsible for any maintenance and support services for the App. Apple has no obligation to provide any maintenance and support services with respect to the App.
Warranty. WaveTracer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
Product claims. WaveTracer, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of the App, including product-liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and consumer-protection claims.
Intellectual property. In the event of any third-party claim that the App or your use of the App infringes intellectual property rights, WaveTracer (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
Legal compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
Third-party beneficiary. You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the Effective Date above and, where appropriate, notify you in the App or by email. Continued use of the App after a change constitutes acceptance of the updated Terms.
